More On Bail Bond Scandal In Hamilton County: Cincinnati Police Didn't Receive Court-Ordered $$$$ Forfeitures

CINCINNATI (TDB) -- At a time when crime is high and up to 112 cops face layoffs due to pinched government budgets, it seems absurd that large sums earmarked for law enforcement haven't reached Cincinnati police and suburban departments.  The Daily Bellwether has located records indicating nearly $2 million in forfeited bail bonds is due and owing.  There could be more; the $2 million is what this blog tracked down in 50 forfeiture cases dating back to the 1990s.  One bail bond company appears to have 26 unpaid forfeiture judgments -- the math indicates the judgments total about $1.05 million.  The business still seems to be writing bonds.  Last week, the courthouse was buzzing with rumors of a federal investigation about a financial scandal centered on uncollected bail bonds.  But the issue goes deeper -- it impacts public safety and keeping cops on the streets.

Officials at the Republican controlled courthouse appear to know they have a problem.  Hamilton County Clerk of Courts Patricia Clancy said in budget documents filed with the county commissioners last month that she was going after the forfeitures:  "The Clerk is also working with the prosecutor to recover forfeited bonds monies that remain uncollected." 

The topic of uncollected bonds received one sentence in a five-page, single-spaced document that admits in its own words local government faces a serious "budget crisis."  Talk about burying an issue.

Why wasn't the recovery effort pursued earlier?   The Bellwether has found records indicating that one of the uncollected bonds dates back to 1991, another to 1997.  Many of the uncollected forfeitures date back to years when Republican County Commissioner Greg Hartmann was serving in the court clerk's office. There are numerous examples of money owed to the Cincinnati police, who are supposed to use forfeited bail bonds to target drug crimes.  But they haven't gotten all the cash that is supposed to come their way from the court clerk's office.  Here's one example from Case No. B 08-05552-B, which involves an accused drug trafficker from Detroit who posted a $200,000 bail.  When the person didn't show up in court, Hamilton County Common Pleas Judge Melba Marsh ordered the $200,000 forfeited.  She signed the judgement entry on April 2, 2009 and said about $160,000 should go to the Cincinnati cops.  Here's are a few pertinent paragraphs from the court order:

"WHEREFORE, it is further ordered pursuant to R.C. 2925.11(E) that the forfeited bond funds on deposit with the Clerk of Courts be paid as follows:
 "First, to the Clerk of Courts to satisfy the costs on the bond forfeiture proceeding; then the remaining balance is to be divided eighty (80%) to the Cincinnati Police Department and twenty percent (20%) to the Prosecuting Attorney of Hamilton County, pursuant to R.C. 2925.50.  In any additional funds come into the possession of the Clerk of Courts relative to the judgment on Bond Forfeiture, those additional funds are to be divided on the same pro rata basis as set forth above.  The aforementioned funds shall be used to law enforcement efforts pertaining to drug offenses."

While that seems to indicate the money was "on deposit," the reality appears to be different.  Four months later, the Clerk of Court's office obtained a certificate of judgment for $200,009 that named the bondsman and the defendant.  It is a legal document showing the debt remains on the books.  Somehow an accused heroin trafficker from Detroit was caught in Cincinnati, posted bond to get out of jail, skipped town, and has yet to deliver the $200,000 a judge ordered forfeited.  And the forfeiture was supposed to go to the Cincinnati police to fight drug crime on the streets.

Here's another example, Case No. B09-004059.  Common Pleas Judge Dennis Helmick ordered an accused drug trafficker to forfeit a $100,000 bond after he failed to show up.  The trafficker is still at-large.  Helmick said on May 1, 2008 that $80,000 should go to the Cincinnati police "for law enforcement efforts pertaining to drug offenses."

That $80,000 doesn't appear to have reached to the police for the fight against street crime.  A certificate of judgement shows the debt is still on the books unpaid.

  3. I e-mail all the county commissioners last nov,2009 I still have the e-mails, Mr Portune said John Williams, Kevin O'Brien, and Patricia Clancey here investigating this then. Here we are a year later and nothing has been done. Except the money owed keeps getting more and more Mr. Trimble racks up loses of around 250,000.00 per year added on the millions he owes. Along iwith the CRIMES we commits but he still gets away with this because of greasing their palms

  4. The judges should be pretty upset that the law enforcement agencies aren't getting their money and the Clerk of Courts is still letting them post more and more bad bonds. This is no way to run a BUSINESS. If you owned a business and you didn't pay you suppliers would they still give you more supplies, but they what happens when you pay people off they don't care about the tax payers who are footing the bill

If the judges want to see what goes on in their courtroom(A) just look on your right at the last row in the back of the courtroom Mr Jones and Mr Wyatt are always waving people over,right there in the courtroom everyday. then when the judge comes in they never stand up. Total disrespect for everyone, then with the new order signed by the judges they still solicite right their in the courtroom and in room 107. They are always in there giving out cards. Just watch in the back of the room. They are afraid to come out in the hallway because they will be filmed and go to the department of insurance, who does nothing

  8. Bail bonding is such a good resolution when someone put up on a jail, whether innocent or not. Everybody should be given a chance to defend themselves. But we have to be very careful choosing the best bail bonding agency who will serve at their best for their clients.

But in Hamilton county you have a bunch of liars, cheaters who break every law out there and the clerk of courts helps them by taking money and allowing them to do anything they want, what a shame. When people (bondsmen) and (clerks) perjure themselves they should get the same treatment as everyonr else. You don't put the fox in charge of the hen house and thats what they have did in the jc clerk of courts office

  10. I have a feeling anonymous is hiding some bones in the old closet! I know bail bonds companies that have apprehended defendants in Hamilton county. Forfeiture does not mean that the bond company pays. Usually, the judge gives the company an opportunity to bring back the defendant. Usually, the Judge wants the defendant back so they allow the companies more time to get them.
    It isn't like T.V. Some of these people are hard to find. I still find it difficult to give anybody merrit that hides behind an anonymous name. You are the same basher that has been on here since these articles broke. What is you angle "anonymous"? I am sure their is a lot more to it than what is being published. Pretty ironic it is being published before elections.

    If you are trying to be incognito with posting under "Anonymous" you are really telling on your self and exposing your true identity.

    With that, you can only be but one person, who would truly be that ignorant. So, come on Debra if you are going to tell the people of Cincinnati about all the shady "Bail Bondsman" don't leave your self out of the story. I don't see where you explained that you,(Debra H.) were "ONCE" a bail bondsman who lost her license, or that you (Debra H.)are a "Convicted" felon. (public record)

    I understand that you want to ring the bell tower about the shady Bail Bondsman. But, really anonymous (Debra H.) some of what your are posting is so far out in left field that you really are showing people just how ignorant and vengeful you are.   13. In regard to post about "anonymous" having poor grammer skills: Her grammer has nothing to do with the law! There are many professional people in the legal system that evidently can't read or write well, or they wouldn't be in the bind that they are in now.
    Not everyone has perfect grammer, like you, even though you screwed up in your first sentence. I guess that means you also have flaws. Also your slinging of words such as "White trash" only shows your true side. So, anonymous, keep on posting so that we can figure out who YOU are.
    Someone possibly putting a "hit" on this woman
    should be taken seriously. Women are killed everyday by vengeful little troll like men. Could you be one of them?

    Debra A. Henneke used to be married to my uncle Marty Henneke. She never changed her name to Henneke when she was married to my uncle he has been passed away for over ten years and now all of a sudden she uses his name?? And her real name is Deborah Rogers, Daniels, Henneke, Allen. She has been married so many times. She took all of my Uncle Martys things and sold them when he died to buy drugs and you name it. My cousins never got anything to remember there dad..because she is a demon. As for these bailbonds men I do know of them and Mr. Trimble is a great man, he may have bond forfeits but I know he tries his best to pay them. I am sure his only daughter is devestated with all these comments going on about her father. All I have to say is someone anyone look,look in to the past of Deborah Rogers,Daniels,Henneke,Allen and get her in jail...she used to be a hair stylist and own her own salon but the irs closed that down and took her house...she is a crook and working with the devil. She needs lots of prayers, because after this life we all go to heaven or hell there is no other place and by the looks of her actions she will be destined to hell. And before anyone slanders these other bailbonds man look at yourselves, are you perfect in gods eyes????Dont throw rocks at glass houses..Just pray for justice and justice will prevail.

  15. Why doesn't everyone quit bashing each other and wait to see how this comes out in court. The person who referred to Debra H as white trash is apparently involved in this mess also. When we break the law, the majority of us WILL get caught and have to suffer the consequences. Whatever happened in the past to any of us, is in the past. We all have skeletons in our closet. Also, if Ms Henneke is or was such a bad person, I am sure she would have not been able to be liscensed as a bondswoman. Granted, her liscense were revoked, but the real criminals still carry one. Or do they?

What about your Uncle Ray and when he went to jail and lost his licenses, just like your Uncle Ronald.I love it your "Uncle Marty" had nothing he lived in my house and drove my cars. Everything there was mine. I even paid his fine to the Department of Insurance when he stole the money from the insurace company to keep him from going to prison. How soon we forget. What about his own daughter, how many times has she been married. Of course Mr Trimble is a great man, he had all his girls down there getting his sexual favors when his wife was dying. His daughter don't even have anything to do with him because of that.What about your Uncle Ronald and Aunt Janet Trimble their house was taken because they didn't pay for it, but thats ok when its a Trimble. She owned many hair salons not just one, stupid. But you know everything. What about your Aunt Connie out drunk everyday and getting throw out of her place, because she don't pay the rent. Whats her name one day its Trimble and the next its Henneke. Believe me I know plenty on those Trimble's and they are just no good. I'll be standing there when they put the handcuffs on them, cheering.   24. A judge is not required to do this, the judge can require a defendant to post bail, which is cash or property of the entire amount.

  30. I just want everyone to know that I have had to deal with this person first hand and she is a complete criminal. I have never dealt with a crazier person in my life. Not only did she send a man who used a fake name to try and handle business for her, she harassed and threatened me and my boyfriend. This person lied to the police and acted insane with them. The police now know what kind of person that Debra really is. This Debra person if very unstable and nobody should do business with her. I think that it is very sad because at her age, she should act like an adult. Apparently, that is not something that she is educated enough to know how to do. Please be careful if you do business with her because she will rip you off.
